Terms of Use

Anyone is welcome to join and submit videos to the site. SpiritFlash is monitored by its users and depends upon each member to comply with the following:

SpiritFlash serves a networking tool to assist Seventh-day Adventist members involved in ministry. Sponsored by the Pacific Union Conference, the site is sponsored by the research and development arm of the Pacific Union known as Church Support Services.

SpiritFlash hereby grants you permission to access and use the Website as set forth in these Terms of Service listed below. Your use of the site means that:

A. You agree to only upload videos that relate to the following categories:

* Mission Projects
* Outreach Evangelism
* Pastor to Pastor
* Spiritual Nurture
* Unique Ministries

B. You agree not to distribute in any form any part of the Website, including but not limited to user submissions (any form of content provided by other registered users), without SpiritFlash's prior written approval.

C. You agree not to alter or modify any part of the Website, including but not limited to SpiritFlash's embeddable player.

D. You agree not to access user submissions (defined below) or SpiritFlash content through any technology or means other than the video playback pages of the Website itself, the SpiritFlash embeddable player, or other explicitly authorized means SpiritFlash may designate.

E. You agree not to use the Website, including the SpiritFlash embeddable player for any commercial use. Prohibited commercial uses include the following actions:

* Sale of access to the Website or its related services (such as the embeddable player) on another website;

* Use of the Website or its related services (such as the embeddable player), for the purpose of gaining advertising or subscription revenue;

F. If you use the SpiritFlash embeddable player on your website, we ask that you include a prominent link back to SpiritFlash website on the pages containing the embeddable player.

G. You agree not to use or launch any techologies, including without limitation, "robots," "spiders," or "offline readers," to bombard the SpiritFlash server in a given period of time with more requests than a human can reasonably produce in the same period by using a conventional on-line web browser. However, SpiritFlash does grant public search engines permission to use spiders to copy materials from the site for the purpose creating searchable indexes of the materials for general web search use.

As a user, you agree not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the user comments or email addresses for any commercial solicitation purposes. You agree not to solicit any users of the Website with respect to their User Submissions.

H. As a member of SpiritFlash, you promise to comply with these Terms of Service, and all applicable local, national, and international laws and regulations.

While SpiritFlash assumes no responsibility for monitoring the site, it will, when it deems it appropriate, investigate activity in connection with the site that SpiritFlash believes may be illegal, unauthorized or a breach of the terms of this Agreement. If deemed appropriate by SpiritFlash, it will initiate appropriate legal action with respect to such activities, including without limitation, criminal, civil and injunctive redress. SpiritFlash reserves the right to restrict your activity on, and/or block your access to, the Site any time for any reason without notice to you.

Submitting Videos

Please Note: In addition to the above, in order to subit videos to the site, individuals must create a login and be willing to follow the guidelines listed below.

1. VIDEO LENGTH - Videos should touch on some aspect of ministry and may not be more than 5 or minutes (give or take). If they are much over this they may be deleted. Actually, you will get more people to view your video if you keep it short (1-2 minutes). Videos MUST NOT exceed 100 MB.

2. ALLOWED MEDIA TYPES - mpg, avi, mpeg, wmv, mov, rm, dat, mp4, flv, 3gp. When submitted to the site, these files are automatically converted to flash.

Please respect the SpiritFlash Community. Unlike YouTube, SpiritFlash is not meant to be a destination site for entertainment, but rather a church ministry site that features short video clips that depict what indvidual Adventist members, groups and organizations are doing to share the good news of Jesus Christ.

We Review Items Flagged As Inappropriate

When a video clip, audio file or photo gets flagged as inappropriate, we review it to determine whether or not it violates our Terms of Use. If it does, we will immediately remove it and send a warning to the person who submitted it. If it happens again, the person who submitted the inappropriate videos may be removed from SpiritFlash.

Site Language: Currently, videos approved for broadcast must be in English.

Site Guidelines

SpiritFlash is a religious site that features content that is of a spiritual nature. We are looking for videos that depict people involved in nurture and outreach evangelism. This means we aren't looking for videos that feature family vacations, craft making, sports or other recreational activities. Obvisouly, SpiritFlash will not allow pornography or sexually explicit content. If this describes your video, don't post it. Also, be advised that we work closely with law enforcement and will report child exploitation.

Videos that do not fit our purpose and mission, as stated above, will be deleted.

It should go without saying, but we will say it anyway--don't post videos showing dangerous or illegal acts, animal abuse, drug abuse, bomb making, graphic or gratuitous violence. Do not submit any videos that depcit someone getting hurt, attacked, or humiliated.

Don't submit videos that try to shock people's senses or gross them out. We will not accept divisive theological or political statements, videos of accidents, dead bodies or identifiable names on tomb headstones. Do not submit war footage that depicts people dying or violent acts.

Copyright Alert

Only submit videos that you have made, or that you have obtained the rights to use. If you submit something that someone else owns the copyright to, you may be sued.

You also need to make sure your videos do not feature content that someone else owns the copyright to, such as music tracks, songs, clips of copyrighted programs, or videos made by other users, without their permission.

Background Music

When choosing background music for your video clip, please keep in mind that SpiritFlash's primary mission is to convey helpful ideas and resources to members and church leaders that relate to ministry. We're not opposed to upbeat music as long as it doesn't take away from what you're trying to say.

Copyright Law - Remember, you do not have permission to rip songs from store purchased CD's and use them with your video without permission from the artists and/or record producers.

It should go without saying that we don't permit hate speech which contains slurs or the malicious use of stereotypes intended to attack or demean a particular gender, sexual orientation, race, religion, or nationality.

Violations of the Terms of Use may result in a warning notification, or may result in termination of your account and deletion of all your videos. The SpiritFlash Admin team will decide whether your video violates our Terms of Use.

How to Handle Copyright Violations

If you are a copyright owner or an agent thereof and believe that any User Submission or other content infringes upon your copyrights, you may provide SpiritFlash with the following information:

(1) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

(2) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a list of such works at that site;

(3) Identification of the material that is claimed to being used without permission, along with link(s) or other information that will help SpiritFlash locate the material.

(4) Information reasonably sufficient to permit SpiritFlash to contact you, such as an address, telephone number, and, if available, an electronic mail;

(5) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

NOTICE: Material that has been uploaded to SpiritFlash without regard to copyright law will be pulled from the site as soon as we are notified.
